Terms of Service

Effective May 17, 2026 · Read carefully — these terms form a binding agreement between you and tondomarket.

1. Who we are

"tondomarket" (we, us, our) is a Ghanaian online classifieds and marketplace platform that lets buyers and sellers discover each other for the sale of goods and services. We operate from Accra, Greater Accra Region, Ghana. tondomarket is a connection platform — we are not a party to any transaction between buyers and sellers.

2. Accepting these terms

By creating an account, posting a listing, contacting a seller, or simply browsing tondomarket, you agree to these Terms of Service, our Privacy Policy, and our Seller Policy. If you do not agree, please do not use the platform.

You must be at least 18 years old to register, post a listing, or transact through tondomarket. If you are under 18, you may only use the site with the supervision of a parent or guardian who accepts these terms on your behalf.

3. Your account

You agree to provide accurate, current information when you register, and to keep that information up to date. You are responsible for the security of your password and for all activity that happens on your account. Notify us at support@tondomarket.com immediately if you suspect unauthorized access.

We may suspend or terminate an account if we reasonably believe it has been compromised, used for fraud, or used in breach of these terms.

4. Using the platform

You may use tondomarket to browse listings, message sellers via WhatsApp or our in-app chat, save items, follow sellers, leave reviews, and (if you are an approved seller) publish listings. You agree NOT to:

Post listings that are misleading, fraudulent, or describe items you do not own or cannot legally sell.
Sell prohibited items (see section 6).
Harass, threaten, defame, or impersonate any person or business.
Send spam, phishing links, or solicit transactions outside tondomarket with intent to defraud.
Scrape, harvest, or extract data from the platform using automated means without our written permission.
Attempt to bypass security, rate limits, or access controls.
Upload malware, viruses, or any code that disrupts the platform.
Use tondomarket for money laundering, terrorism financing, or any activity that violates Ghanaian law.

5. Listings & transactions

If you are an approved seller you are solely responsible for the accuracy of your listing, the legality of the item, and the fulfilment of any transaction. You agree to be honest about the item's condition, price, location, and delivery options. Stock photos must clearly indicate they are stock photos; the buyer should not be misled about the actual item they will receive.

tondomarket does not process payments between buyers and sellers — transactions are arranged directly by the parties. We do process certain platform-fee payments (verification fees, advertising fees, subscription fees) through Paystack. By making such a payment you also agree to Paystack's own terms of service.

We are not responsible for the quality, safety, legality, or delivery of items sold through tondomarket. Disputes between buyers and sellers are between those parties, although we will assist with reasonable factual information where we can.

6. Prohibited items

The following may not be listed on tondomarket:

Illegal drugs and drug paraphernalia.
Firearms, ammunition, explosives, and weapons restricted under the Arms and Ammunition Act 1972 (NRCD 9) or any successor legislation.
Counterfeit, replica, or pirated goods — including software, music, films, and luxury items.
Items that infringe a third party's intellectual property rights.
Human remains, body parts, organs, or any non-medical biological material.
Live animals offered in a way that may breach animal-welfare laws.
Stolen goods. Anything where you cannot prove lawful ownership.
Adult or sexually explicit content.
Items related to scams, pyramid schemes, or "get rich quick" offers.
Cryptocurrency mining contracts, ICOs, or unregulated investment schemes.
Prescription medication and tobacco products.
Any item that is illegal under Ghanaian law or whose sale would violate any law of the buyer's or seller's country.

We reserve the right to remove any listing, with or without notice, that we reasonably believe violates these terms or applicable law.

7. Fees

Browsing tondomarket is free for buyers. Sellers may pay for optional services such as verification badges, listing boosts, premium subscriptions, and advertising campaigns. Current prices are listed on our pricing page and within the seller dashboard.

All fees are non-refundable unless explicitly stated otherwise or required by Ghanaian consumer-protection law. Pricing is in Ghana Cedi (GHS) and inclusive of any applicable taxes unless noted.

8. Intellectual property

The tondomarket brand, logos, software, design, and platform content (other than user-generated content) belong to tondomarket and our licensors and are protected under the Copyright Act 2005 (Act 690), the Trademarks Act 2004 (Act 664), and international copyright treaties. You may not copy, reproduce, distribute, or create derivative works without our written permission.

You retain ownership of the content you upload (photos, descriptions, videos, reviews). By uploading content to tondomarket, you grant us a worldwide, non-exclusive, royalty-free licence to host, display, promote, and re-format that content as needed to operate the platform and market it. This licence ends when you delete your content, except where we have already used it (e.g. cached search results, archived backups).

9. Reviews and reports

You may leave a review of a seller you have transacted with. Reviews must be honest, factual, and based on real experience. Fake reviews — whether positive or negative — will be removed and may lead to account suspension. We may, but are not obliged to, mediate disputes about review content.

You can report listings, users, or messages that you believe violate these terms via the Report a Scam page. Reports are investigated by our trust & safety team.

10. Privacy & data protection

We collect and process personal data as described in our Privacy Policy, in line with the Data Protection Act 2012 (Act 843). Using tondomarket means you accept that policy.

11. Suspension and termination

We may suspend or terminate your access, with or without notice, if:

You breach these terms or any policy referenced here.
We are required to do so by law, court order, or regulatory authority.
We reasonably suspect fraudulent, illegal, or harmful activity on your account.
You repeatedly post low-quality, duplicate, or rule-breaking listings.

You can close your account at any time from your account settings. Closing does not refund paid services, and certain transaction records may be retained as required by law.

12. Disclaimers

tondomarket is provided "as is" and "as available." We do not warrant that the platform will be uninterrupted, error-free, secure, or fit for any particular purpose. To the maximum extent permitted by Ghanaian law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

We do not endorse any seller or product. The presence of a listing is not a guarantee of quality, authenticity, or availability.

13. Limitation of liability

To the maximum extent permitted by law, tondomarket, its directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or goodwill, arising from your use of the platform or any transaction between users.

Where liability cannot be excluded by law, our total liability to you over a 12-month period is limited to the greater of (a) the total fees you have paid to tondomarket in that period or (b) GHS 500.

14. Indemnity

You agree to indemnify and hold harmless tondomarket, its officers, employees, and agents from any claim, loss, liability, or expense (including reasonable legal fees) arising from your breach of these terms, your listings, your transactions, or your misuse of the platform.

15. Changes to these terms

We may update these terms from time to time. When we do, we will update the "Effective" date at the top and, for material changes, notify you by email or in-app banner. Continued use of tondomarket after the change means you accept the new terms.

16. Governing law & disputes

These terms are governed by the laws of the Republic of Ghana, including the Electronic Transactions Act 2008 (Act 772), the Cybersecurity Act 2020 (Act 1038), and the Sale of Goods Act 1962 (Act 137) where applicable. Any dispute arising from or relating to these terms will be heard in the courts of Accra, Greater Accra Region, Ghana.
